1. ACCEPTANCE OF TERMS

By accessing or using sanctumaspen.com(the “Site”), you confirm that you have read, understood, and agreed to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, you must immediately discontinue use of the Site.

SANCTUM PBC (“Company,” “We,” “Our,” or “Us”) reserves the right to update, modify, or replace these Terms at any time. Any changes will be effective upon posting on the Site. Your continued use of the Site constitutes acceptance of the updated Terms.

2. EDUCATIONAL & INFORMATIONAL USE ONLY

The content on this Site, including but not limited to blog posts, videos, courses, resources, and information on psychedelics, wellness, mental health, therapeutic practices, and microdosing, is for educational and informational purposes only.

SANCTUM PBC operates in compliance with Colorado’s Natural Medicine Health Act (NMHA) and applicable state laws. Psilocybin and other natural medicines remain federally illegal under the Controlled Substances Act. Licensed Facilitator Services: Any psilocybin journey, integration coaching, or therapeutic support offered by the Company is conducted in compliance with Colorado law and is available only to individuals who meet the eligibility requirements.

Microdosing Support: The Company provides educational resources but does not sell or distribute psilocybin to the general public. All products are available only to licensed facilitators and healing centers as permitted by law.

No Guarantee of Outcomes: Psychedelic use carries inherent risks. The Company is not responsible for any personal, psychological, or medical effects resulting from your use of psychedelic substances, including those facilitated under Colorado’s legal framework.

4. LIMITATION OF LIABILITY

To the fullest extent permitted by law, SANCTUM PBC, its owners, officers, employees, affiliates, and contractors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

The use or misuse of information found on this Site
Adverse physical or psychological reactions from psychedelic use
Third-party services, providers, or content linked on this Site
Business losses, revenue losses, or any claims related to reliance on the Site’s content

You assume full responsibility for your decisions, actions, and any consequences resulting from engagement with the Site or our services.

5. INTELLECTUAL PROPERTY

All content on this Site, including but not limited to trademarks, logos, text, videos, educational materials, and digital resources, is the exclusive property of SANCTUM PBC unless otherwise noted. 7. PAYMENT, REFUNDS & CANCELLATION POLICY

SANCTUM PBC offers services that require payment. By making a purchase, you agree to the following terms:

All sales are final. Refunds will not be issued for services already rendered or digital content accessed. Exceptions to the refund policy apply when the required safety screening identifies a medical contraindication; in such cases, a refund will be issued less a non-refundable $300 screening fee per person.
If you enroll in a payment plan, you authorize recurring charges until the balance is paid in full.
Cancellations for in-person services (e.g., retreats, guided journeys) must be made at least 32 days in advance to be eligible for a partial refund (minus administrative fees)
SANCTUM PBC reserves the right to deny service to anyone at its discretion.

8. GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by and interpreted in accordance with the laws of the State of Colorado, United States. Any disputes arising from these Terms shall be resolved exclusively in the courts of Pitkin County, Colorado. If a dispute arises, you agree to first attempt resolution through mediation. If mediation fails, disputes shall be resolved through binding arbitration, waiving the right to a jury trial.

9. PRIVACY & DATA PROTECTION

SANCTUM PBC respects your privacy and protects your personal information in accordance with our Privacy Policy. By using this Site, you consent to our data collection, storage, and processing practices. We do not sell or share your personal information with third parties without consent, except as required by law. However, we may use cookies, analytics, and other tools to improve user experience.

10. TERMINATION OF USE

We reserve the right to terminate or restrict access to the Site or any of our services at our discretion, without notice, for violations of these Terms or any applicable laws.

b. No Professional Advice

Nothing on this website, in communications with our team, or in connection with our services should be construed as business, financial, or investment advice.

c. No Guarantees or Promises

The Company does not guarantee any specific results from the use of its Site, services, courses, or educational materials. Psychedelic journeys and integration processes are deeply personal, and experiences vary significantly. SANCTUM PBC reserves the right to remove any user from our platform, courses, or services at our discretion if they violate these guidelines.

13. REFUND POLICY & SERVICE DISCLAIMERS

SANCTUM PBC provides non-refundable services, including but not limited to:

Psychedelic preparation and integration coaching
Digital courses and downloadable materials
In-person retreats, events, workshops, and ceremonies

Retreat & Journey Cancellations:

If you cancel more than 32 days before a scheduled retreat or guided journey, you may receive a partial refund minus administrative fees.
Cancellations made within 32 days of the event are non-refundable.
In the event of an emergency, you may request to transfer your spot to a future event at the discretion of SANCTUM PBC.

14. GOVERNANCE OF ONLINE SALES & SERVICE AGREEMENTS

All purchases made through SANCTUM PBC’s Site are subject to these Terms and Conditions. By making a purchase, you agree to:

Provide accurate payment and billing information.
Not attempt to reverse or dispute charges through your payment provider unless fraud is suspected.
Acknowledge that payment processing is handled by third-party providers and that SANCTUM PBC is not responsible for technical issues related to payments.

Chargebacks or disputes that violate these terms may result in legal action and reporting to credit bureaus.

15. FORCE MAJEURE CLAUSE

SANCTUM PBC is not liable for failure to perform any obligation under these Terms due to unforeseen circumstances beyond our control, including but not limited to:

 Natural disasters (fires, floods, earthquakes)
Government regulations or legal changes
Pandemic-related restrictions
Technical failures or cyber-attacks
Business disruptions outside of our control

In such cases, SANCTUM PBC reserves the right to reschedule, modify, or cancel services without liability.

16. MODIFICATIONS & UPDATES TO TERMS

SANCTUM PBC reserves the right to update these Terms at any time. Changes will be reflected with an “Updated On” date at the bottom of this page. Continued use of the Site constitutes acceptance of any changes. If any portion of these Terms is deemed invalid or unenforceable, the remaining sections shall remain in full force and effect.
